In order to comply with Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, and in particular Article 10 thereof, the following legal notice is made available to the user.

Access, navigation and use of the website https://anjanadata.com (hereinafter, the “Website”) implies the tacit and unreserved acceptance of all the stipulations of this legal notice, having the same validity and effectiveness as any contract concluded in writing and signed.

Its observance and compliance shall be enforceable against any person accessing, browsing or using the Website. If you do not agree with the above conditions, do not access, browse or use the Website.

This legal notice regulates access, navigation and use of the Website, without prejudice to the fact that ANJANA reserves the right to modify the presentation, configuration and content of the Website, as well as the conditions required for access or use. Access and/or use of the Website after the entry into force of its modifications or changes implies acceptance of the same.

However, access to certain content and the use of certain services may be subject to certain specific conditions, which will in all cases be clearly displayed and must be expressly accepted by users. These particular conditions may replace, complete or, where appropriate, modify those established in this legal notice.

For the purposes of the interpretation of this legal notice, it is understood that a person becomes a user (hereinafter, “User” or “Users”) at the time that he/she accepts this legal notice and the privacy policy set out on the Website.

Accessing and browsing the Website implies that the User of the Website fully accepts and agrees to comply with this legal notice in its entirety, as well as the instructions or recommendations that are indicated to him/her in each specific case through the Website.

Access to the contents of the Website is completely free of charge.

When a User provides personal data through any of the forms provided for this purpose on the Website, it will be necessary to accept the Privacy Policy beforehand.

Under no circumstances shall ANJANA be responsible for the veracity of the data provided by Users, and therefore each User shall be solely responsible for the possible consequences, errors and failures that may arise from the lack of accuracy of the data.

 

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS 

Rights on content 

ANJANA owns or, where applicable, has the corresponding licenses for the exploitation rights of intellectual and industrial property necessary to operate the Website, as well as all the content offered on the Website, including the Website itself, texts, photographs or illustrations, logos, brands, graphics, designs, interfaces, or any other information or content, and the services available through the Website.

Rights over the Website 

Under no circumstances shall it be understood that access, navigation and use of the Website by the User implies a waiver, transfer, license or total or partial assignment of such rights by ANJANA. The User has the right to use the content and/or services of the Website within a strictly domestic environment and solely for the purpose of enjoying the services provided in accordance with this legal notice.

References to registered trademarks or trade names, or other distinctive signs, whether owned by ANJANA or third parties, are implicitly prohibited from use without the consent of ANJANA or their legitimate owners. At no time shall access, navigation or use of the Website and/or its contents confer upon the User any right to distinctive signs included therein, unless otherwise provided for in this legal notice.

All intellectual and industrial property rights over the content and/or services of the Web Site are reserved and, in particular, it is forbidden to modify, copy, reproduce, publicly communicate, transform or distribute, by any means and in any form, all or part of the content included in the Web Site, for any purpose, without the prior, express, written authorisation of CYSAE or, where applicable, of the owner of the corresponding rights.

Likewise, it is forbidden to remove or manipulate the copyright indications or other credits that identify the rights holders of the contents that the User finds on the Site

Website, as well as technical protection devices, fingerprints, or any protection mechanism or information incorporated into the content offered on the Website.

The services offered, or any information made available through the Web Site may not be used for commercial or advertising purposes without prior authorisation from CYSAE.

In any case, the User undertakes not to use the Web Site for illegal or prohibited purposes.

Rights over the content and information disseminated by the User

In the event that the User sends information or content of any kind to ANJANA through any of the channels provided for this purpose, the User declares, guarantees and accepts that he/she has the right to do so freely, that said information does not infringe any intellectual or industrial property rights, trade secrets or any other rights of third parties, and that said information is not confidential or harmful to third parties.

The User acknowledges assuming responsibility, leaving ANJANA unharmed, for any communication or content that he/she sends personally or in his/her name.

Should the User become aware of the existence of any content that is illicit, illegal, contrary to the law, or that may constitute an infringement of intellectual or industrial property rights, or of any other nature, the User shall immediately notify ANJANA at the e-mail address info@anjanadata.com so that ANJANA may proceed to take the appropriate measures.

Similarly, in the event that any User or third party considers that any of the content of the Website owned by ANJANA infringes their intellectual, industrial or other property rights, they must send a communication to info@anjanadata.com with the following information:

1. Identification details and means of contact of the claimant or his/her legal representative
2. Documentation attesting to your status as the owner of the allegedly infringed rights
3. Detailed account of the rights allegedly infringed by ANJANA, as well as their exact location within the Website
   Express declaration by the claimant that the use of the contents has been made without the consent of the owner of the allegedly infringed rights.

Links to other websites 

In the event that the Website displays links to other web pages by means of different buttons, links, banners or embedded content, ANJANA informs that these are managed by third parties, and that ANJANA has neither the human nor the technical means to know in advance and/or control and/or approve all the information, content, products or services provided by other platforms to which links may be established from the Website.

Consequently, ANJANA shall not assume any type of responsibility for any aspect related to the Website or web page that may be linked from the Website, specifically, but not limited to, its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its content, in general.

In this regard, if Users become aware that the activities carried out through these third party websites are illegal or contravene morality and/or public order, they must immediately notify ANJANA so that the link to them may be disabled, an action that will be carried out in the shortest time possible.

In any case, the establishment of any type of link from the Website to another web page belonging to another party shall not imply the existence of any type of relationship, collaboration or dependence between ANJANA and the party responsible for said other web page.

Links to ANJANA’s channel on other platforms and social networks 

ANJANA makes available to Users, through different tools and applications, means of linking that allow Users to access the channels and pages of the Website that it maintains on different platforms and social networks belonging to and/or managed by third parties (e.g., Twitter, Facebook, etc.). The inclusion of these links on the Website is solely for the purpose of facilitating Users’ access to such channels on the various platforms and social networks.

ANJANA does not authorize the establishment of a link to the Website from those pages that contain material, information or content that is illicit, illegal, degrading, obscene and, in general, that contravenes the law, morality or public order, or generally accepted social norms.

In any case, Users may establish links that lead to the Website, provided that they comply with the following conditions

1. The link may not reproduce the content of the Website or parts of it in any way;
2. It is not allowed to create a browser or a border environment on the sections of the Website, nor can the Website be modified in any other way.
3. It is not permitted to make false or inaccurate or incorrect statements or indications about the Website and/or, in particular, to declare or imply that ANJANA has authorized the link or has supervised or assumed in any way the content or services offered or made available on the web page where the link is established.
4. ANJANA does not have the power or the human or technical means to know, control or approve all the information, content, products or services provided by other websites that have established links to the Website. ANJANA does not assume any type of responsibility for any aspect related to the web page that establishes such a link to the Website; specifically, but not limited to, its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its content, in general.

 

RULES OF USE OF THE WEBSITE 

It is not allowed and, therefore, its consequences will be the sole responsibility of the User, access or use of the Website for illegal or unauthorized purposes, with or without profit. In particular, and without the following list being restrictive, it is prohibited:

1. Use the Website in any way that may cause damage, interruptions, inefficiencies or defects in its operation or in the computer equipment of a third party.

Failure by the User to comply with any of the foregoing obligations may result in the adoption by ANJANA of the appropriate measures protected by law and in the exercise of its rights or obligations, which may include the deletion or blocking of the account of the offending User, without any possibility of compensation for the damages caused.

 

RESPONSIBILITIES AND GUARANTEES 

ANJANA cannot guarantee the reliability, usefulness or truthfulness of all the information and/or the services and content of the Website, nor can it guarantee the usefulness or truthfulness of the documentation made available through the Website.

Consequently, ANJANA does not guarantee nor is it responsible for

1. The continuity of the content, services and/or functionalities of the Website
2. The absence of errors in such content
3. The absence of viruses or other harmful components in the Website or in the server that supplies it
4. The invulnerability of the Website or the impossibility of violating the security measures adopted for it;
5. The lack of usefulness or performance of the contents of the Website
6. The damage or harm caused, to oneself or to a third party, by any person who infringes the conditions, rules and instructions established by ANJANA, or through the violation of security systems. Nevertheless, ANJANA declares that it has adopted all necessary measures, within its possibilities and the state of the art, to guarantee the functioning of the Website and to reduce system errors to a minimum, both from a technical point of view and in terms of the content published on the Website.
7. ANJANA does not guarantee the legality, reliability, or usefulness of the content provided by third parties through the Website. Should the User become aware of the existence of any content that is illicit, illegal, contrary to the law, or that could constitute an infringement of the rights of third parties, the User shall immediately notify ANJANA so that the latter may proceed to take the appropriate measures.

ANJANA shall not be responsible for the truthfulness, integrity or updating of the information published on the Website from sources other than the Website, nor for those contained in other platforms to which the Website links. ANJANA shall not assume responsibility for any hypothetical damages that might arise from the use of the aforementioned information.
9. ANJANA shall not be liable for causes beyond its control, which may include, but are not limited to: force majeure, problems with Internet access, technological problems beyond the diligent and reasonable management of ANJANA, actions or omissions of third parties, etc. In all of the aforementioned cases, beyond the control and due diligence of ANJANA, there shall be no possibility of ANJANA compensating the User for damages or losses, to the extent permitted by current legislation.

SUSPENSION OF THE WEBSITE

ANJANA reserves the right to suspend, modify, restrict or interrupt, either temporarily or permanently, access, navigation, use, hosting and/or downloading of the content and/or use of services of the Website, with or without prior notification, to Users who violate any of the provisions detailed in this legal notice, without the possibility of the User demanding any compensation for this cause.

DATA PROTECTION

In accordance with the provisions of Organic Law 3/2018 of 5 December on the Protection of Personal Data and the guarantee of digital rights, all personal data collected during the use of the Website will be treated in accordance with the provisions of the Privacy Policy, which every User must expressly accept in the event of providing personal data through the Website.

GENERAL

The headings of the various clauses are for information only and shall not affect, qualify or extend the interpretation of this legal notice. Furthermore, ANJANA may modify the conditions stipulated herein, either totally or partially, by publishing any changes in the same manner as this legal notice appears, or through any type of communication addressed to Users.

The temporary validity of this legal notice therefore coincides with the time of its display, until it is totally or partially modified, at which time the modified legal notice shall become effective.

ANJANA may terminate, suspend or interrupt, at any time and without prior notice, access to the contents of the Website, without the possibility of the User demanding any compensation whatsoever. After such termination, the prohibitions on the use of the content set forth previously in this legal notice shall remain in force.

In the event that any provision of this legal notice is declared null and void or inapplicable, in whole or in part, by any Court, Tribunal or administrative body

If you are not satisfied with the accuracy of this information, the remaining provisions of this legal notice shall not be affected by its invalidity or non-application.

The failure of ANJANA to exercise or enforce any right or condition contained in this legal notice shall not constitute a waiver thereof, unless acknowledged and agreed to in writing by ANJANA.

 

APPLICABLE LAW AND JURISDICTION 

The regulations in force shall determine the laws that must be in force and the jurisdiction that must be aware of the relationship between ANJANA and the Users of the Website. However, whenever such regulations provide for the possibility of the parties submitting to a specific jurisdiction, for any litigious matter arising from or related to the Website, Spanish legislation in force at the time of the facts shall be applicable. Likewise, ANJANA and the Users, expressly waiving any other jurisdiction that may correspond to them, hereby submit themselves to the Courts and Tribunals of the city of Madrid (Spain).
